Evil Air Intake? What's the problem?

Why are these "Custom Air Intakes" that are metal instead of plastic not approved for on-road use? Is that a paranoid disclaimer, or would these really screw up emissions or something? It just seems so...non evil.
Also, I just want it because I think it looks awesome. Would this really yeild any performance benefit?

EDIT: Didn't realize this replaced the whole intake - thought it was just a replacement tube between airbox and engine! Still, I'm curious as to its possible evils. Metal is an excellent heat conductor, which is not what you want in an air intake. You want to keep the incoming air as cool as possible. Synthetic materials like plastic and silicone do much better than metal, because they conduct heat less.
The airbox in the 12v engine is not the restriction it is made out to be. The biggest restriction to airflow are the plenum and the throttle body. The airbox is oversized for the 12v! A cone filter is also not the best option for an air intake on the 12v.
Whether or not intake mods (any mods, really) are legal depends on your local laws. Any mod may be categorically illegal, unless it is officially sanctioned. The seller is just covering his *** by saying "off road use only."

So what you're saying is my first step to increase performance (and from what I hear, mileage) is to get a S3 TB? Where exactly can I do that? I've seen lesser ones around for sale, but no "3's".
