Dang, I just read about the VWVortexer that is being sued by Jim Ellis VW for libel. CRAZY!

It's scary to think that you could be sued for recommending against a dealership that provided bad service. Only in America.

I can understand this guy's frustration with the dealer. By all accounts he had a crappy service from this dealer. That being said, what he wrote may be libel, at least by the legal definition of the word. By my copy of Black's Law Dictionary libel is defined as: A statement or representation published with out just cause tending to expose another to public contmept.
The post is a statement or representation that tends to expose another to public contempt. The key is whether or not he had just cause to do so. He was rightfully pissed at this dealer for shoddy service, but did that give him "just cause" to publish the post? That is a legal conclusion for a trier of fact to decide. A judge may decide that he had many other ways to report and express this greiveance, i.e. report it to VW, the Better Business Bureau, write to the Consumer Protection Agency, etc. etc.
I personally don't think the case will go far, free speech is widely protected, but the whole thing raises an interesting issue. How far can you slam someone on the web before it gets to be a legal problem?
