Has anyone ever had an APR ECU go into "Limp Mode" ??

First off, my car is a 1.8T Tip with APR 91 octane ECU software. About a month ago this problem began to develop. From a standing start, the car has virtually no low end torque. This is to the point where the car feels like the parking brake is engaged. Some people may say that this is normal turbo lag, however I have never had this loss of low end power during the 1.5 years of having the APR chip. As soon as the car hits approx 2,800 RPM's, the engine begins to break free and pull like normal. This is opposed to before when the engine would pull smoothly through the RPM's.
The car has been with my mechanic, who is Bosch certified, for the past 3 weeks and he swears that he can find nothing mechanically wrong with it. They have checked virtually everything. When he uses his VAG-com tool to "Re Learn" the ECU, the car regains the low end torque. However, after some time driving or sitting, the car will become "dumb" again and lose the low end torque.
For the record, the APR people have taken the fifth and only comment that there is no possible way that the software is causing this. I will be sending them my ECU soon so that they can flash it with their latest version.

If it runs fine, deduction would lead to the problem being the APR chip. Can you send it back to APR to have it looked at? I've had an APR chip for since mid 2000 and have never had any problems with it (but I bought an extra stock ECU just in case).
