Defendant's Name:
Case No.:
I respectfully submit this written declaration to the Court pursuant to CVC 40902. I plead Not Guilty to the charge of violating CVC 22450(a).
The facts of my case are as follows: While driving southbound on Termino at 2:30 pm on 5-19-04, I approached a stop sign at 14th street. I came to a complete stop, looked both ways to see there were no other cars, shifted from neutral to first gear and began to drive again. I was then stopped by a LBPD Officer (Unit# 5408) and was charged with violating CVC 22450(a). The Officer alleged that I was driving 10 mph and did not stop at the stated stop sign.
The Stop Sign Law, CVC 22350, states: The driver of any vehicle approaching a stop sign at the entrance to, or within, an intersection, or railroad grade crossing shall stop at a limit line, if marked, otherwise before entering the crosswalk on the near side of the intersection."
I feel I obeyed this law, and could not have been going 10 mph since I came to a complete stop. As such, I know that I was not in violation of the basic stop sign law at the time and place of my citation and contest that my traffic stop was therefore not prima facie unlawful.
I trust in the Court's fairness and believe that my citation should be dismissed in the interest of justice.
If the court does not find in my favor in this case, I request a fine reduction and a Court assignment to attend traffic school.
I declare under penalty of perjury under the laws of the State of California that the foregoing is true and correct.
