Default oh and....

what about a personal injury lawsuit??? Even though you might not have been physically hurt the post traumatic stress must be eating away at you. Just the unsafe feeling you have on the road...

Default The P.I. Lawsuit usually isnt worth it. Beleive me,.....

I lookied into it. Im working on becoming an associate at a huge firm in chicago. I used my resources and it just woul dno thave been worth the time, $ and effort to sue for injuries. You may get some for medical expences. Im still waiting for my INS. company to get back to me about that. Takes some time. Ive heard, since im not in PI law i dont knwo for sure, typically you can expect somewhere between 3-5 x you med bills back from other INS. Company.

The accident. I was doing 45-50mph. He turned left in front of me moving to my right. My front left to his front right came together. He was in a HUGE ford truck and I threw him accross (in the air) a gigantic intersection into some trees. People near by saw the whole thing. Did you have witnesses?

yeah i had 2 witnesses that say that he ran the red but also that it appeared that I was speeding.

I unfortunately don't have much faith in the competency or determination of my attorney.

Default In my case, they said....

it wouldnt have mattered if Id been speeding or not. I probably was actually. They didnt care. Like I said, PI cases are tough and long. Get a better attorney if you decide to go through with it. Have you heard anyone say if they think the other side will accept liability? Thats big obviously. That took like 2 weeks in my case. And find out about getting money for upgrades. Its possible. They tried to convince me that it wasnt.

wisconsin is a comparative negligence state, so they are admiting to fault... it's 60/40 is what they are admiting to. My attorney is advising me to accept the 60% offer because i was speeding and the length of the skid marks. I say that's total bull**** and i'm not going to go through with it. I want 80% at least.

Default Re: Generally running a redlight or stop sign gives higher fault then supposed speeding

I would swing by the local police department and chat with one of the officers and see what they come up with. If you seam like a pretty ordinary guy they might have a few good comments. Ask your freinds if they know any cops as they may give you more information. Definately consult the state vehicles codes to see exactly what you both were sited for.

Actually, a good accident investigator/reconstructionist can do it easily

Default Im sorry bro...

In my case they accepted 100% liability. Speeding is not nearly as harsh an offense as running a god damn red light. Id hold and get as much as I could. You may be screwed.
