Car is a 2001 APR Stg 3+

basically the issue is a get a code to trigger when i am accelerating at part throttle (around 10PSI for a consistent period of 5 seconds). Then car goes into limp mode. VAG-COM reads overboost- pressure exceeded. However, I am able to reach full boost of 22PSI but that does not trigger the code. why or what triggers the overboost at only 10PSI?

Things I have done so far:
-Serviced Forge BPV
-EBC in place of N75 with N75 routed back to itself
-no boost leaks, though there is a noise of air that sounds like a duck at higher boost levels and i cant figure that one out. originally thought BPV but that's not it.

Things I'm wondering are
-Wastegate not opening properly? (turbo has 6k miles on it)
-My VAG-COM wont log (doesnt want to link to car) so cant log it

I guess with this info if you have any ideas or had the issue of part throttle overboosting and where to go that would be grateful. or need further info i forgot.
