Whats the longest time after an accident can you file a claim? I rear ended someone about .......
5 weeks ago and they havent filed a claim toward their insurance company. I want to fix my bumper and hood using my own money and not involve my insurance, but im not sure if the lady i hit will call her insurance. If she does, then i would rather have my insurance pay for the bill since it will go up if she calls. Her trunk was kind of messed up, but it was a company car, so she doesnt know what will happen. i cant get a hold of her company. no one picks up the phone there for the past 5 weeks.

and if they, your ins., do contact you...you may be hosed.
my agent has a sign in his office stating some law about not reporting. I would call a random agent from another co. and ask questions. His sign may be a hoax but It'll keep me straight till I hear otherwise.

He's right. You should call them.
Your insurance premium will ONLY go up if they have to pay out a claim for which you were at fault.
Conversely, your insurance premium will NOT go up if:
1. You were not at fault
OR...
2. They do not pay a claim (or if the claim is below a certain threshold.)
You do not need to initiate a claim with the insurance company. But you should let your agent know about the accident, and get some advice on what to do.
Maybe there is a reason why this woman hasn't filed the claim yet. Was her insurance expired? Was her licence, registration, or inspection expired? Any of these factors would immediately put her at fault, even though you rear-ended her.
Your agent can help you determine this.
Or as Skene says, she might be waiting, pretending to be in the hospital, and having a lawyer figure out all the medical bills before she files the claim. Hope that's not the case.
