Default X-Post from A6 forum...Damn NYC...Hit a huge hole in road left by Con Edison..vent and advice needed

friday night, hit this huge hole in the ground along with 4 other cars. result? 5 cars with flat tires.

my car seems to have taken the most damage. i need two new wheels and tires (one tire has a bubble in it now). the front bumper was scratched underneath from not hitting the hole, but hitting the block that was covering the hole. my xenon headlights are messed up, they point straight down into the ground and dont auto level anymore. i popped the hood open and tried adjusting it with the adjustment screws with no luck.

now when im cruising at highway speeds, my car shakes.

we called the police and all filed police reports and they wrote down that we all had undercarriage damage and also put down on my car that my headlights were messed up. they said to contact insurance and have them take it up with Con Edison.

I called my insurance and they said that if i were to claim, i would still have to pay the deductable and that if wanted Con Ed to pay, i would basically have to sue them.

my questions are:
1. would my insurance go up if i claim?

2. should i pay the deductable and sue Con Ed for the deductable or should i get it fixed out of my pocket and then sue them for all damages?

3. anyone know any good shops in the NY/NJ metro area?

i would like to benefit from this like:
1. instead of 2 new stock wheels, get some aftermarket ones and pay the difference.

2. since i might have some suspension damage, have them install my audi/eibach springs while they're at it.

thanks for reading this long post.

all advices are greatly appreciated.

JaTe

Default go to Art Audi Body in Nyack - that's where I went last summer - same prob - 1-845-358-3083

they installed my remote radar detector for free
(I did half the installation)
they'll install your springs
- tell em Mohammad Zafar sent you
- def go through insurance, just in case
there is damage to the car that you can't see -
also, my damage last year ended up being
$1500
also, Art Auto body will tow the car and include
it in the bill to the insurance, so you don't
pay em a dime up front.
Go for the new rims. Talk to Martin, he'll work
it out with you and help as much as possible, also,
they're friends with most of the insurance
adjusters in the area. Art Auto Body works
mostly on Audis, I'm getting mine back today,
they did a great job - last year when the
pothole took off my engine shield and cracked
the oil pan, they did an amazing job. They also
installed my one-piece headlights for free cause
I asked em too - they never charged me for it.
Raffe is the guy who would most likely work on
the car, Martin takes care of the business end.

Default Maybe write a letter to Con-Ed stating the damages with pictures stating that you ...

fully expect them to pay...in full...I dont know if I would mention suing...

Default Several people have filed against the city for pothole damage in Toronto ... and won.

Several of the cases documented that the pothole condition was noted to MTO (Min. of Transport) more than 24 hours prior to the damages. MTO never took steps to repair or mark the pothole and were required to pay for complete repairs.

I'd check with your local roadworks department and send them a notorized letter stating the facts along with the documentation from the other witnesses/victims. Get a good lawyer who will follow through.

Luck

Default MY dad won in Manhatten a few years back, actually all he did was...

write a letter with pictures and the bill for the wheel and tire and they sent him a check like 1.5 months later. not much effort at all on his part, i think it was 1 phone call for the address and the letter

this is the first and best strategy. If this doesn't work, then think think about litigation.
