ATF question: what might cause ATF to turn black in less than a month/400km?

I had my dealer change out the ~75,000km (60k miles) old ATF less than a month ago, only to get a torque converter problem where it stops locking up after driving for a short while. I brought the car back to the dealer, they took out the TC, to find that the ATF is darker than the old ATF they flushed out; worse yet there's clutch plate material mixed in. Dealer is starting to say it's the Pentosin ATF-1 that I brought in that caused the problem, but it's carrying the right spec far as I can tell... Can you guys suggest some possible reason for this? Or direct me somewhere I might get some answers?

The tech who worked on the car however decided that the old ATF was clean enough that there was no point putting it in... Incidentally this tech was alleged to have underfilled my tranny by 'bout 1.5 litres: that was the remedy when I first brought the car in for the TC issue, before I took it in a 2nd time, CEL light ablaze.

I was told over this over the phone so I don't know if it smells burnt, but I'd imagine so. Is there something else that'd make oil hot enough to essentially burn? In your opinion is it more likely the dark fluid is a consequence of a failed TC, or that the dark fluid caused the TC to fail?

the new filter in... That said, in my mind the old filter shouldn't lead to such a catastrophic consequence, should it?
