as well as whether the problem is fixed or not. Audi isn't going to give you another car without documentation that they can't fix the car you have now. They document stuff too, but that is for their records, not yours. Unless the car has already been in the shop a few times prior to now for the same problem, you are going to have to give them the chance to fix the car.
The dealer should be a neutral party who is trying to fix your car for you. If you are talking about a buy-back, you need to approach Audi corporate. If you feel the car now qualifies for lemon law status according to your state's rules, start talking to the service manager about who to contact. The dealership itself isn't going to give you another car as they did not build the car, and so cannot be at fault for it's reliability.
At this point though, I haven't seen any other problems with other cars with the CVT. Let them ( try at least to ) fix your car.

you can ask for a new car but they will probably not give you one. lemon laws in most states require a certain number of attempts and/or hours for the dealer to fix the problem. i am going through the same thing right now. they are replacing the transmission on my 2002 a4 with 1k miles on it. most people here told me it was normal for my shifter to vibrate heavily in 2nd gear......audi certainly didn't think so.

the whole item is removed and replaced with an entirely new unit. They want to make sure that the part stays fixed, and not have to go back to fix it again. The part goes back to Audi for them to dismantle and check.
