unfder the law, they will have to prove it to a judge, who is NOT a mechanic
most judges see common sense.
AS I SAID ....the DEALER has to prove to the court that the chip caused the problem beyoind any reasonable doubt.

well its cool you know BEFOREHAND about your dealer being dicks
just go to another dealer. the odds of the CHIP actyually frying any real component is minimal at best.
