I was just wondering if he had a CarFax proving it had structural damage before purchase.

The recent discovery that the car needs further repairs associated with the collision damage, would be key. Do you want to have the seller buy it back or do you want to sue for the cost of repair? Maybe you should inquire with the Attorney Generals Office to obtain the relevant law in your state. If there is an obvious violation in the consumer protection law, then a letter from the Ag's office to the selling dealership would be helpful getting a buy out.

mistake #1 - trusting the word of a car salesmen. Face it, 90% of all car salesmen lie for a living. They are always hiding something from you, whether its something important or not.
mistake #2 - did you ask them for a carfax? If a dealer does not offer me a free carfax, I will not buy from them. To me, if you have nothing to hide, you will proudly show your customers that this car is indeed a great find.
mistake #3 - nothing is in writing. You can't come back a year later and claim that you found damage to a body panel and expect anyone to compensate you. How can you prove that now? If you went to a dealership shortly after the sale and they said that there was something wrong with it, then that was the time to speak up. Now, your word vs. theirs.
Unfortunately it's always "buyer beware". I feel for you, but at this point there is nothing you can do. Attorny fees to settle this claim won't be cheap, and rest assured they won't budge an inch until you have an attorney involved. Even then no guarantees as I'm sure you are not the first person to ever accuse them of not disclosing something. They know their way around - it is after all, how they make money.
