That's the first I've heard of that. I don't think pushing the torque limit is the problem, though.
The 5HP24A is only rated for 420 Nm (310 ftlbs), but engineers (especially German ones) generally put a conservative "guard band" around their specs for safety. I'd be surprised if the 5HP24A couldn't handle 400 ftlbs all day long. My guess is that there are other parts of the design that may just be generally unreliable (parts that are not part of the power transmission section part of the transmission). Do you know what kinds of failures people have had?
My S6 is putting out 380+ hp and more than 310 ftlbs of torque and I drive it hard (at times) with no tranny issues (knock on wood). My 5HP24A has been rock solid.
