Yes, they are still liable. They won't weld in test pipes even if you remove the cat
If they do anything to circumvent or disable emissions equipment they could get in big trouble. Your best bet is to first determine if you have loose material in the cats. If you do remove them and break out the core. This will probably cause a CEL, but it will prevent power loss and heat build up due to a clogged cat. This should only be a temp fix until you can replace the cats.

I have no problem gutting them and using CEL eliminators. However, who would be
willing to weld them back together after I've gutted them? That would be just like putting in a set of straight pipes for me..
