Default If Jim Ellis Motors would win this case, this could mean that anyone posting negative comments

about Audi, the dealers, or even someone, could be sued?

Seriously I'm a bit surprised by this. I've always though that the USA was THE World Democracy, where anyone could voice their opinions as long as they were true.... and that your Constitution protected those rights.
Could someone clarify this for this far away foreigner?

Default Andre, the short and (overly simplified) answer is that the Constitution protects against government

actions, not the actions of individuals. The government is not prohibiting the disgruntled consumer from voicing his complaints; the target of his complaints has alleged that they constitute libel, and it's one private party suing another one to address a perceived grievance.

Where's VWoA in all this? First the dealer treats their customer like crap, and then they sue them?

Default Apparently the customer posted their VWoA case number, asking other form members to intercede

as a form of "revenge". Doubt VWoA was amused by the hassles.

Default The right to sue is there, just as is the right to free speech.

Tends to be the lawyers who defend the right to sue, though. I once heard of a woman who sued a pancake restaurant because they didn't have the advertised flavor when they said they would. Sued for pain and suffering. Thrown out of court, but she had the right to sue...

For every anecdotal nut case like the one you cite, there are also injured parties who truly have been damaged who don't want to see their recourse to the courts tossed out (by insurance companies or whatever). What's wrong with that case? The system worked, she got tossed. And she and her lawyers had to bear their own costs.
