Engine Oil Fill Level? Mid or Max of dipstick?

As most of us may or may not know, engine oil expands when hot. In some circumstances when there is too much oil in the engine and running it at high rpm's it can create excessive pressure to the engine and may also damage the catalytic converter.
I had gone to get an oil change at the dealership and checked the level on the dipstick (when hot) it was slightly above max line. Dealer claims its ok and that that where its supposed to be. He said it would eventually burn off.
What an asnwer huh....yea maybe burn off after 5k miles .. and i change my oil every 3k (sythetic)
I disagree and wanted to find out from anyone else that might be able to help me with the correct answer.
So...
When the oil is hott, where on the dipstick is the adequate level where the oil should read?
Max Line?
OR
Middle Area?

But oil doesn't expand very much in the operating temperature range of an engine. If you read your owner's manual, it probably states that you should check the engine oil level when the engine has been turned off for a few minutes because all of the oil that is pumped up to the upper end (which far exceeds any oil expansion due to heat-up) drains back into the crankcase. Therefore, hot or cold, you oil level should not exceed the MAX mark on the dipstick.
