still more on the mmi update and "lawyer screen"

i had my 2005 A8 in the shop last week.
I showed the dealer TSB 2015136 (about the surround setting), and he told me my MMI software had already been updated when my car was in for service in January of 07, and that my MMI software release level was already at the latest available, thereby making the TSB unnecessary.
Yet my car still gives me the lawyer screen every time I start it.
I had understood that once my car has the latest MMI sw, I'll no longer see the lawyer screen. Am I missing something, or is my dealer? Or might this be VIN-specific (mine is a pre-bluetooth model, early 2005)?

...though now i'm not sure what to say to the dealer.
i showed him the TSB, and urged him to double check after he told me it wasn't needed. He seems like a good guy and I don't think he's deliberately trying to stonewall me... he might just not have access to the latest Audi info. Any ideas as to how I can spoon-feed this process to him?

All you can do is advise him once again of the "surround sound" setting (front or rear) DSP BOSE not holding after a sleep cycle of the MMI and show him the level of your SW and that it is NOT the level of 33.6.0, which enables it to fix the surround setting issue. He is probably balking because it may require (not in my case as I have a very qualified staff at Nalley-ATL), I think, a regional type techy to do this and it may also require a different CD player to be installed to read this later version of the MMI CD, as the earlier '04 A8's had an older model CD Player which then requires the dealer to install this newer player. I continue to think alot of these MMI lack of SW updates relates to the ineptness of the personnel in the service bays and service writers desk. You have to wonder if most of the dealers having the problems are NOT the "true" full scale Audi dealers.
Off point: When are they going to make these cars 3G capable and then updates, etc can be downloaded via the internet. I just saw a TeleNav service on a cell phone, why the heck should cars, going forward, have regular NAV period?

If so, kind of hard for the dealer to have actually updated the car in January 2007 for a yet to be published TSB, don't you think? Perhaps you might gently point this out? In plain English, open and shut busted to be honest...
If you don't have the altitude display choice, that is the MMI trivia way to see if you have the latest rev. It didn't exist previously, unlike the lawyer screen which moved around.

using the stock CD player...I pretty know given the ejected music disks they left behind out of the player.
There have been enough updates to MMI that the dealer may see in their service history it has been done in the past, and may not be realizing (or not want to deal with) that there have been a number of updates.
