A3 brake lights problem

I have a 54 plate 1.9 tdi sport which has developed a problem with the brake lights. On a couple of occasions the lights have stayed on after I have locked the car, always cleared when I touched the pedal. Now they have started coming on at random even when the car is locked, they will still go off if I touch the pedal. Audi dealer has had the car for an afternoon with no success (except to tell me my battery is low, surprise, surprise and would I like a new one at £212.50 NO THANK YOU) They don't seem to think that brake lights should work with ignition off but they definitely do. The car is fitted with auto lights/lighting pack with follow me home headligts etc. if that makes any difference. Looking at various forums and threads it seems there are issues with the brake light switch on this model. Anyone got any ideas before I start paying Audi vast wads of cash to chase this problem?

Not sure what the 54 plate means, so I'll ask what year yours is and how many doors (different tail lights)?
I want to know if you the the 09 LED style or the 08 and before regular bulb one.
I've upgraded my 07 to the new style LEDs and wonder if the LED circuit might be bad.

MikeSS, yes I am in the UK and thanks for the suggestion I will give them a try. WillH+A3, 54 is a car registered in the second half of 2004 and no I havent altered the high level light.

pretty helpful bunch on audi-sport.net, and if all else fails, they can at least warn you of which dealership to avoid.
