It's luck of the draw really - both with dealers and cars.
If the A3 doesn't suit your needs, by all means swap it out if possible, before the values drop even more. Yes, you are going to have to take quite a hit because the A3 is in the steepest part of the depreciation curve, but it's not likely to level out for a while.

I have an '06 A3 2.0T DSG while my wife drives an '06 Passat 2.0T Tiptronic. The Passat is a great highway cruiser and is very comfortable and roomy. The trunk is cavernous and the back seat has a lot of legroom.
Both cars weigh about the same (~3300 lbs) but the A3 feels a lot lighter and a bit faster. However, the Passat has the better ride and feels noticeably more solid. The doors on the Passat feel much heavier and make that nice thunk when closing.
Our previous car was an '03 A4 1.8T and we feel the Passat is just as luxurious and definitely more spacious.
Therefore, if you go from the A3 to the Passat, you will get a car that is a lot roomier, rides better, and is more luxurious. You may miss the better acceleration and handling of the A3 but it sounds like roominess is more important to you, so you should go for it.

it's a 2007 A4 CVT I belive that's what it's packin
in sport it has 7 gears listed..

They are both pretty nice cars. I liked the sport package but I am used to that kind of set up in the TT. Make sure you try the sport package.
The thing I didn't like was the delay I felt when accelerating from a stop. I think it was a combination of throttle delay and transmission delay. Once rolling, they were both very responsive and either one would be fun to drive.
