brakes/rotors problem..getting the shaft from dealer

Long story...here goes:
Bought 2001 AR in Oct. Upon test drive I said brakes were stuttering. They said they were new brakes as part of the CPO process and that they would "break in" in a week. I said ok, they were right.
February I complain about brakes again. Stuttering, thumping, etc. at higher speeds (upon braking of course). They check the brakes, say they cannot find anything upon doing their own test.
Inspection due in April, ask to check brakes again since problem is still evident. They call me and say I need new rotors and pads on front. They say approx. $400. I argue with them and they say they cannot pass the car without the rotors, pads. My goal was to have them pay since I only put 5K on it since Oct. when it supposedly had "new" brakes.
They said the rotors warped from overheating due to use by the operator of the car. He told meto downshift more (I have a tiptronic).
CPO says if brakes have 50% they pass, if less they replace. Even if not new should I have gone through the pads in 4 months (Feb when prob started)?
Anyway...should I call Audi of America and share this with them? Any advice? Sorry for the length!

driving habits, the length of time other brakes last and all the complaints since day 1.
The dealer may have done a rubber stamp CPO being the dealer should have fixed the brakes prior to CPO inspection at his own cost which could be why they "ignored" your requests.
