but this is wshere you have to trust your insurance company to 'subrogate' with the offender's insurance to get back your deductible.

I have found this rarely happens.

Its always better to go to the source yourself.

I'm working from experience... we were backed into by an allstate covered car. We filed directly with allstate. I never filed with my carrier. The offender's policy paid 100% including daily rental.

If it's clearly the other persons fault the deductible should be returned through your insurance company. I agree that 1st try the other company for coverage but as in the last case I was involved in the other company did not want to use new parts and argued each item with the body shop. I called in my company and things were fixed right with no hassle. Couple of months later the deductible was returned. I have also been with the same agency (1st the father and now the son) for over 30 years so there is some history.

Always remember that it's not in an insurance company's best interest to pay claims.

Default Allstate is telling me "I" have to make up the difference and/or go after the insured. Never been

told that in my life.

Default its all how you filed the claim from the start... restart the process now...?

just call the Lady's insurance company and fiel a claim. See how it goes. You have nothing to loose and everything to gain.

Default In the state of Washington you have the right to have your vehicle repaired at

any shop YOU choose at no cost to you. The repair must be to OE specs. If replacement parts are required the insurance company will try to have the shop use aftermarket parts. Do not let them do this, non OE parts in my opinion are junk, most are made from thinner metal and the fit is close they are far from perfect. Every aftermarket panel I have installed needs work done to them for that perfect fit, my .02 they suck.

My concern here is are you going through you insurance company or the other party's company. Dealing with your own company is a bit more difficult but law is law. The other party hit you they are at fault and are liable for the repair again at the shop of your choice.

I agree. You need to file the claim with the lady's insurance, not yours.

I have State Farm, the lady's insurance is Allstate. I'm leaving my insurance out of it.

Default What state are you in? In PA everyone files a claim with their insurer and then their insurer goes

after the other person's insurance for reimbursement. If they get it, you get your deductible back. I was told by my insurance company to file this way so that I didn't have to wait for repairs and each time I got my deductible back in a month or so.
