Default Any suggestion on how to resolve this matter?

When my car was delivered two weeks ago, there was a damage (scuffs and cracked paint) on the rear driver side bumper. It's not noticeable from about 10 feet but the damage is there. The driver has denied responsibility and said that the damage was already there prior to pick up from the Seller's location. I was actually in Colorado the day before the car was picked up and I did not see that damage. I have some pictures to back it up and of course, the sellers word.

According to his transport report that he went through with the seller and signed, there was no indication of the damage on that particular side.

Anyway, to keep this short, how do I get this driver/owner to pay? The estimate to repaint the bumper ($975). I filed a claim against his insurance company but since the damage was under $1000 and well below the insured deductible, they are basically saying go away and deal with the insured.

I faxed to the driver the estimate and thinks the amount is riduculous, and that he thinks the bumper can be repainted for $500 dollars.. And listen to this. He said that since there are other little scuff on the bumper which I won't argue about - that he needs to split the $500.. so he's basically only going to send me $250.

If I take him to small claims court, I have to file it in Idaho where he resides, correct? Then the cost of flying to Idaho and the days off work that I am going to take will pretty much equall the cost to repair the damage. So I am in a limbo here not knowing what to do next.. Grrrrr!!!

Any other ideas to pursue this?

Default Let's see a pic of it.

Honestly, if he's not going to pay all of it, I'd try to get anything you can from him without going to court. That would be a hassle not worth getting into.

If he'll give you anything, after all else fails, I'd take it. Show him the pics too of before and after.

Default does he work for a company or is he private?

Complain to anyone higher up than him if he works for a company. Show them the sheet you are given with the damage that he listed before he left with the car. These guys have insurance for this stuff. Did you show him the damage when the car was dropped off? Did you put it on the paper you signed when you got the car? That stuff helps.

Default Thank god you did'nt mention anything about lawyers in your post.

We don't want to go down that slope again. $950.00 is a ridiculous price to pay for that bumper to be painted. It should be more like $300 to $400. E-mail me if you need a body shop reccommendation.

Default having shipped 5 cars i can tell you your probably better off taking the hit yourself but call

he's willing to give me $250 beacause he said there are already other existing scuffs. I guess I'll take what I can get and just stomach the frustration..

is it Comet? I talked to Mr. Comet regarding the front bumper on the S4 but we never got around to doing it.

I am afraid of paint matching though as most shops say Pearl White is the hardest to match. I guess i'll just avoid walking by on that side of the bumper.

Default for future reference stay away from these guys. stick with bigger companies and

there is a federal website to check the insurance and records of every shipping company.
