I was told a long time ago about the speed limit sign placement, and how they had to be a specific distance (600m) apart when in an area at a strange speed (ie... 60km/h where you'd expect an 80km/h zone).
Anyone know where the rules are kept for this?
Can't find it in the normal HTA.

you can prove to the court that there were no postings on the roadway from where you entered and (assuming it was rural) you were going the lawful speed of 80kmh.
If it wasnt rural, you'd be limited to 50 kmh until a sign was seen.
More info would help in explaining what to do.

My understanding is...
-she thought it was a 60 zone. (outskirts of the GTA... heading to scarborough from Stouffville... not sure what route.)
-she got a ticket late last year, and since then, has been **** about speed limits and never doing more than 10 over.
-she was coming down a hill and let the car coast up to a higher speed, planning to slow down at the bottom of the hill (doing 69km/h)
-cop stopped her, told her she was in a 50 zone, and doing 19 over. (69 in a 50)
3 points and a ticket. He told her to fight it and that they would lower it to drop the points. I know that will happen... it's not unrealistic to lower to 15 over.
I'm not worried about the fine or points... my concern is the insurance. Just one more conviction which could drive up her insurance rates. She isn't a bad driver... I know bad drivers!

I want to go see the area... find the 60km/h sign she thought she was obeying, and find the 50km/h sign the cop was using.
Perhaps the sign was missing all together which is why she missed it.

what method was used to verify speed? I've won two separate speeding charges, one of them thrown out of court because they could not provide me with requested documentation.
If the person charged was caught speeding by "pacing", there is a very good chance of winning the case. I can help you out if that is the case. Otherwise, I don't have enough experience to give you good advice.
