Default Drunk Conduct BT: in canada is it illegal to be passed out in your car

with the keys put in the trunk?

i.e. you're sleeping in your car to sober up/protect it/ then will drive later on

can you still get a ticket/fine/impound?

Default I don't think there's a stationary violation :)

But why risk the chance of puking in your car when you can do that at your friend's place?

Default I think it depends which seat you are in . . .

seriously . . I think passed out in the driver's seat, not moving, can still get you in trouble, but any other seat is fine.

Default I would doubt it. Nobody's life is at risk. I knew somebody that did this last Saturday...

he was waiting for his wife to come to the car, wake him up, and then drive him home. He was dead tired but she wanted to hang out a while longer, so he went to the car to sleep a bit. Nothing wrong with that.

Default Police do have means of creating a problem from this. Who is to say you won't still be "drunk"

when you wake up? I think they will give you grief. It's not as much of a slam dunk as you may think.

Default I'll ask my cop friend and get back to you, but it's my understanding that you can be charged with

impaired as soon as your keys are put into the ignition.

They may be able to charge you with something else though.

Default Illegal (in Ontario at least, assuming Canada-wide)

It can be argued that you could have care of the vehicle even in that situation, thus you can definitely be charged. The keys' location is actually irrelevant, they could be locked in a safety deposit box and you can still be convicted.

A close friend works at a rehab, and teaches Back on Track on weekends (Ontario mandated program for those convicted of DUI). You can be walking towards your car with the keys in your pocket and still be arrested and convicted for impaired driving. It's absolutely draconian. Thanks MADD!

I can email her for more detail if people are really interested, but just don't mess with it. Stay out of your car if you're pissed.

Default re keys in ignition: In the driver's seat, you could always slip the car into neutral

and disable the parking brake (if it's not off already) and roll into traffic/somebody/something.

Default There are people on the road who are impared 24/7. I have a friend who blew .33 @ 10:30 AM

Mind you he was on the way home from the bootlegger. Lord only knows how many percs he had in him at the time.
