Default Well the car is fixed

Damage wasn't so bad (all cosmetic).

Story doesn't end there however. Since the bastage that hit me wasn't insured I had to pick up my deductible ($300). Plus the time off work and all that crap.

I called the guy tonight and suggested it might be in his best interests if he were to help cover some (read ALL) of my costs.

Doesn't have any money he says, will pay me in 2 months he says. Tough **** I say, filing in small claims court tomorrow I saw. See his *** in court as soon as I can push the paperwork through.

The scary thing is that the guy is still on the road driving, he claims he is insured now, just got his coverage last week. I highly doubt it tho. Methinks he is still on the streets as another accident waiting to happen.

I want to nail his *** to the wall tho.

Default Hmm, I think that last time I was hit by an uninsured motorist...

my insurance company at the time (State Farm) waived the deductible? Or maybe I just forgot they bill me for it?

Default I'm going to contact the insurance company

I was 100% not at fault in the accident.

So I'll push to get my deductible back. It's the reason I pay for bloody insurance and I'm not thrilled at all with how this is working out.

Default Agreed. It shouldn't be you filing a claim to recover the deductible from the deadbeat...

it should be the insurer.

There is a term for that process, I just can't remember it at the moment.

Default Did you file a report at a collision center?

I think a not-at-fault report was what got me off the hook for the deductible. If cops were at the scene, a copy of their report should be good enough.
