Your car is OBDII.... they'll never look for it....
VA no longer does the dyno test or the sniffer test IF the car is OBDII. They plug into the system, just like VAG-COM, and pull the information from the ECU on how its managing fuel/emission. So it all depends on how the car THINKS its running.

in VA most shop/gas stations can do the inspections..
VA has two inspections... emissions every 2 years, safety every year.
Depending on the inspector, the CAN (and I've seen it done) fail you for the car being too low. It was a mini truck and the kid/driver was being an ***. They brought the truck in for the safety inspection. Mechanic kicked over the arms for the lift and they hit the frame, so he couldn't raise the vehicle. Truck got a nice bright red REJECTED sticker.
