Paging Roger: How long has that pothole that I hit on Fairfax Dr. been there? You said you drive by

If I can't get this resolved through a normal process, I'm going to small claims court. F- VDOT.
I've got enough evidence and law that I think I can win.
I may need notarized statements from people attesting to the fact that that pothole has been there for some time and that the state has hadconstructive knowledge of it.
I'll reimburse you for any incidental expenses.

that pothole will probably be filled up by today.
you should also take pictures of the depth of it.
something similar happened to me last year in the same vincity. i tried getting my insurance company to go after vdot and they didn't even budge. their legal department gave some BS answer saying it wouldn't work in court b/c the a4 is low according to oem. i just gave up on it considering that the state usually will stand up for the state.

Your insurance company is making a financial judgment
It would cost them more to fight than to just eat the loss--especially since they'll likely try to take it out on your premiums.

you need to contact fox 5 or some other local newsstation and send em pics and stuff
maybe they will make special out of it and show videos of cars running into the hole. maybe that will get the attention needed if the whole is still there
