It's not illegal to modify the exhaust, it's only illegal to modify the exhaust to make it louder than what it was when it came from the factory.
But inorder to prove this (if you get a ticket and you plead not guilty) the officer will have to somehow show that your exhaust is louder than stock exhaust. The easiest way is to get you to admit it. So they'll ask you a few questions to try and get you to say that your exhaust is louder than stock. I've had this happen before... luckily I knew the law and didn't say anything. The cop let me go with a warning ;-)
If they don't get an admission then they will have to prove that your exhaust is louder than stock. So they'll need some sort of proof. This will likely have to be decible levels of a stock exhaust on your car compared to decible levels of your exhaust on your car. Nearly impossible to prove with the limited resources PD's have.
While the officer can say he *thinks* your exhaust is louder than stock... a few simple cross examination questions will quickly poke holes in that. An officer clearly is not an expert in exhaust notes of all cars.
So while the law doesn't require decible levels, the police will still need some sort of decible levels as proof. They know this, so they try to get you to admit to it.
