Default He is what they call a "low blower"

Make sure his attorney hires a PI to do additional investigation and collect testimony from those he was with so they can back up his story of not drinking in excess.

This sucks because he was not breaking the law, and now its going to cost him a pretty penny.

I know of another AudiWorld.com member who drank like 15 beers, drove off the road and had the charges reduced to reckless driving... plus he was under 21.

Default cough/cold medicines = dui FTL. and to kris, under 21 why arrest? .07 and 21 would definitely be

arrest, no?

Default Your friend should get off if he presents himself properly.....

If he was a college room mate a few years back, I assume he is over 21. My guess is that your friend was borderline on the sobriety test. He needs to present himself well in court, however.

Default If I'm not mistaken .08 = DWI, .07 = DUI

Technically he didn't break the law but he still got arrested. I don't know what the punishments are for DUI... it also varies from state to state.

Default DWI vs DUI varies by state, and not every state makes a distinction between the two

Not sure what MA does though.

Default isn't refusal of breathalyzer automatic arrect plus loss of license plus hefty fine?

or can you request a blood test instead? does requesting a blood test vs a breathalyzer still put you in the 'refusal' category which looks to have very stiff penalties

Default You'd have to drink a huge amount of any sort of medicine for it significantly raise your

blood alcohol level.

Default I meant, if he's over 21, but blew under .08, why the arrest?

Unless he answered the question "when was your last drink" wrong..

ALWAYS says 2 hours ago. ALWAYS. It takes time for the alcohol to get into your blood. If you blow a .07, and your last drink was half an hour ago, you are not as drunk as you're gonna be yet.

Default That's why I always tell the officer that I was going so fast because I wanted to get home...

...before I got <i>really</i> drunk!
