Default Question for Lawyers or others that know law

I just registered a car (non-audi) and was charged sales tax based on the NADA trade-in value of the car which was $4100. Even in excellent condition the car is probably worth $2k retail and half that as a trade. But I paid $850. Doesn't it seem like aside from being a screw job that there would be some legal issue in making people pay a sales tax that is in excess of the actuall sales price or true value of the item purchased? The law is Massachusetts 830 CMR 64H.25.1.

I thought you paid tax on the purchase price, based on the bill of sale.

Purchase price or NADA trade-in value. Whichever is HIGHER

Default no kidding. the same thing happened to me when I bought my truck.

"retail" value was over $3000 higher... ouch.

Default That's BS.

Yet another reason I do't like living in this state. I'll bet not one cent of that extra tax I paid on my car went to road repairs...as I paid over twice the blue book value for my car.

Default Its because otherwise people would write the bill of sale for $1

rather than the actual value.

Default Same in CT, but here you can submit an affidavit signed by both buyer and seller...

showing true sales price and they will refund the difference. So much for "innocent until proven guilty" - lol

Default But I shouldn't be penalized for that.

People cheat on their taxes too but that doesn't mean I should pay the greater of what I earned or what the IRS thinks I should have made.

J:

My 200 20V was DMV valued at $5000 when I bought it and paid 1/3 of that. Pretty annoying when it didn't even run.

Register it in NH as some sort of trust.

Excise = air tax.
