Default The ghetto of Bound Brook vs. Solaris (Certified). Will this be enough for dismissal? (longish)

This is in NJ. The basic story is that I followed all laws except for the one on the ghetto sign that says "No Turn on Red" in a rather inconvenient place.

This first picture is my view of the "No Turn on Red" sign as it was at the time of the violation. I am stopped at the stop line (actually 3 feet before). Where is the sign? You may ask. See the metal posts between the two utility poles? It's on that, ABOVE my car.

This is my view of the rightmost signal post at that intersection. No sign.

Here is a woman stopped exactly where I was. Notice that the "No Turn on Red" sign, between the utility poles, is almost behind her.

Now we have the view of the intersection as you make the approach. Nice how the intersection turns off to the left and that important, partially blocked, signal sign is tucked away to the right.

Another view of the sign. Notice how there aren't any other signs for this. There should be one on the opposite side of the intersection, on the signal head or post for which it applies. Unfortunately, this kind of setup is within the DOT's guidelines. But is this reasonable?

And yet another. Notice the rope that's tied to the posts. That rope goes around the utility pole behind the sign to support it. Total ghetto crap.

Now, who thinks I can reason with the judge for dismissal? My story will be short and simple. I stopped at the stop line, looked at all signal posts for a sign, didn't see any, waited a good 5 seconds, checked for traffic, and proceeded to turn right with caution while paying attention to the crosswalks and crossing guard who was present. I'm not going to cry obstructed sign or improper support, just that I made every attempt to follow the laws and simply did not see a sign.

Default No way will that be dismissed. You can see the sign as you approach the stop light.

Your own pictures show that as you approach the stop line the sign is visible.

If it makes you feel better. I got a No Right on Red Ticket in the middle of nowhere upstate NY many years ago at 2AM. I got off the highway, went to the end of the off ramp and turned on the red light.

Cop was sitting in the dark off to the left and nailed me.

Default Well, it doesn't make me feel better, but thanks. I can't believe garbage like this is legal

Regardless of what the weak DOT standards are. In the statutes for this sign, they only "suggest" placing the sign near the signal head for which it applies, or on the signal post. That's what I look for. I shouldn't expect a judge, who is out to rake in more money for their ghetto, to use reason. For all I know, they made this intersection difficult on purpose. Fascists.

Default I think you can present a pretty convincing argument

and I would imagine they might consider those good points. I am also of the opinion if the sign is mounted as pathetically as that one, they have no right writing tickets against it. good luck

Default Thanks. I hope the judge has a mind as open as yours. The worst case scenario for me is...

the court fees + the fine itself. I have a PA license and won't get points if guilty.

Default Bring your pictures to court...leave out the approaching intersection pic.

You have a case, but if you show that you can see the sign as you approach, like CTA4AVANT said you probly won't get it dismissed.

Default It's not up to code (imho) the view of the sign must be "unobstructed"

DId the code say the sign need to be at the stop line? or at the same place as the Light?

Default The statutes are so vague. I can't remember what it actually says, but...

it really wasn't specific about where in the intersection it should be.
