They have been doing something similar from the West Seattle bridge to I-5N junction.

No they can't

They cops have to witness the infraction in order to write the ticket for HOV violation.

I use the HOV all the time to get around left lane bandits. My favorite it watching people get all upset when I'm in the HOV with the top down after 7:00 pm (most HOV lanes open up to general use after 7:00 but nobody bothers to read the signs).
