Insurance settlement question...

Default Insurance settlement question...

Wife was in an accident last year where she was rear-ended. It was totally the other person's fault, so they covered repairs.

The other persons insurance agent called and said that in WA state there is a settlement payout that officially closes the case between us and them. She said it was a one-time payment that was done to cover the "inconvenience" of the accident.

Is this familiar to anyone? I am not one to agree to a payout before figuring out what the real laws are. They said for no major injuries, typical settlements were like $200 to $500.

The wife was not injured, but visited a physical therapist twice to have her back examined. She was pretty sore from the accident, but so far has suffered no permanent injuries.

Anyone have any idea?

Default Don't be too quick to settle

the other insurance agent is partially right. However, your wife may suffer from minor tissue damage, or more importantly a stiff neck or back that lasts for the remainder of her life. Typically, you can argue with the other parties insurance. They sent me a check for $500, I called and told them to go to hell. A couple months later a check for $3000. That is how I was able to purchase my most recent car

Default did you have any serious/lasting injuries? What was the extent of your accident?

She was sans Audi for about a month, driving ****-*** rental. Then, since the insurance company was paying for the rental but not rental insurance, she didn't get the insurace. Lo and behold, someone does a hit-and run and dents the side of the Cavalier and we're out another $500-$600. LOL.

So:
* Soreness for a month
* $500-$600 to Enterprise rental
* No car for a month
* Depreciation of car

Do I have a case here?

Default the guy was a complete moron. his insurance took care of it all

He did send me to the hospital for the better part of the day. I missed sea fair!

Default Usually your insurance will cover any damages to the rental.

I broke out the windshield on my rental, $50 deductable, that's all.

Explain the inconvenience to them. Mention, but do not threaten with the option of a lawyer.

I don't think you'd make much more money with a lawyer.

Add up all doctor bills, and get an estimate of future bills.

Add up the missed days at work, depreciation on the car, inconvenience, and mostly your premiums.

Even though you weren't at fault. Your insurence knows, and it's documented. I just changed agents, and my NOT AT FAULT raised my rates

Default I just paid out of pocket for the damage to the rental...

... because I didn't want it going on MY insurance and getting hit with raised premiums.

I will at least bring that up with them.

Any ideas on depreciation information? Where can I get an estimate of that?

Default I was told by my insurance adjuster that medical claims are not closed until 3 years have passed.

At least in WA. But it would have to be documented that your wife received injuries from the accident. She may want to go to her doctor for a check up.
