Most students are paying the $3000. I saw this in the newspaper not so long ago.

Default First; Don't stress, the RIAA wins very very few suits.

Do a little research and I can point you in the right directions. The main issue that the RIAA has not conquered is the fact that the IP is never directly linked to you. If you do some research, you'll find quite a few people who have beat the RIAA easily and were also awarded attorney's fees. Also, try contacting the EFF (eff.org)

Here is one link to get started:

Also, call your ISP at threaten to sue them if they release or have already released your information. Scream alot, demand the supervisor and supervisor's supervisor, and tell them that they are violating privacy law. Remind them that ATT & Verizon are getting heavily sued for giving out info to the govt and they probably gave out your info w/o even a court order and/or warrant.

If you want some help, email me. Don't freak out yet, you still have time to decide what to do. Also, if you just want it to go away, I think the average settlements are around $3k.

Disclaimer: I am not a lawyer.

Default I'm not a lawyer but I'm in law school at UO

and this has been driving me crazy for years. The link from muvment to the http://recordingindustryvspeople.blogspot.com/ is a good place to start reading about the RIAA's strategy from a lawyer's perspective.

you can also read some thoughts about other similar cases here.

I can't give you legal advice, but I can tell you that an increasing number of defendants in these suits are fighting the RIAA successfully, winning their attorneys' fees, and in some cases winning damages claims against the record industry for the problems caused by the lawsuit. So it might be worth actually talking with an attorney. Where are you located? If you're in Portland / Washington / Seattle, you might want to try to get in touch with someone from Lybeck Murphy LLP, the law firm that has been defending the Andersens from the record industry in a similar case to the one you're facing. see

http://recordingindustryvspeople.blogspot.com/#Atlantic_v_Andersen

for a discussion.
do a google search on "capitol v. foster," read about UMG v. Del Cid here: http://recordingindustryvspeople.blogspot.com/2007/06/riaa-accused-of-extortion-and.html

I'll be checking messages all this week- let me know if you want to chat about this.

2nd this- downloading is NOT the problem. It's the uploading (distribution) that is infringing
