Lets say the cops are on the lookout for someone they have a warrant out for. Lets assume they don't follow procedure and don't alert the officials in Iowa, the state they think their suspect is in. Instead, the police send an officer to Iowa to nab the suspect. The cop finds the suspect, arrests him, and drags him back to WA.

Now, the suspect is in WA, he can be arrested on the warrant, there is no disputing that. However, the officer can also be charged with kidnapping, as he had no jurisdiction in Iowa. Point is, the unregistered car does not mean he was not an officer and it does not mean he didn't witness the driver speeding.

Now if we want to talk about searches and seizures (of person or property) that's a whole different ballgame... (see 4th Amend for starters)

Default That may be, but speeding is an infraction vs the cops's criminal act.

Anyone else taking an old set of plates and putting them on our car would have been arrested.

Default Have you guys seen "No Country for Old Men"? If someone thinks an officer is pulling them over

they always pull over. The situation in the movie is seriously scary. Granted, it is a movie, but if it were to happen, there would be plenty of paranoid people out there.

The cop isn't getting in trouble, neither should the speeder. We call that a "push".

Default Agreed, but how dangerous 10mph over vs. dead cars on hwy 16

The two cars were just past the I5 exit onto hwy 16. One must have stopped to wait to get in while the other was looking back to see if they could merge and wack (just an educated guess) The point I am trying to make is that the WSP had someone pulled over for a minor infraction, while less than a mile away, there are two dead cars on the inside of a VERY busy and hectic exit/merge area. Who is in danger the most, the speeder plus those around him/her or the two cars right in the middle of three lanes gong to two with an exit, etc. and tons of merging going on. We probably agree more than not, but it seems to me, with all my drivng, that the focus is now on money, not safety.

Default This is not the only argument

the argument is that WSP broke the law. You state he broke procedure. Maybe, but breaking the law is a bigger deal. Troop at very minimum should be repromanded.

Agree, speeding ticket stands just for the fact that defendent admitted guilt. But WSP needs to hold themself accountable for breaking the law.
