bigak, sorry to hear about your dealer's strike one. I remember a member here a while back who needed a tranny replacment. He had to wait a month and when the tranny got here, it was the wrong one. Here in MA, if a car is in the shop for more than 30 days or 3 repair attempt for the same problem and the problem render the car unoperational or if its a safety issue, it qualifies for the lemon law.

it's different state by state
Has the Manufacturer Had a Reasonable Opportunity to Repair the Vehicle?
If you can answer "yes'' to any of the following four questions. the manufacturer is presumed to have had a reasonable opportunity to repair your vehicle under Ohio law.
  • Have three or more attempts been made to repair one problem and then the problem occurs again?
  • Has the vehicle been in the shop for 30 days or more during its first year or 18.000 miles?
  • Have eight or more attempts been made to fix different problems that impair the use, value or safety of the vehicle?
  • Has one unsuccessful attempt been made to fix a problem that could cause death or serious injury?

If you answered "yes" to at least one of these four questions, you have the legal right to ask the manufacturer to replace the lemon or refund the entire purchase price.

I had posted earlier this year having to replace my tranny at less than 2k miles. My car was in the shop for 18 days. Here in NJ the lemon law trigger is 20 days in the shop.

I had a similar problem. Car wouldn't go in reverse, or any gear also a message about gearbox malfunction. I let the car sit for a few minutes and tried again and it worked fine. I took it into my dealer and they said it was the first time they had seen the problem. They had to special order a new module I believe and we had a loaner for about 5 days. Its had about 8000 miles since and problem free.
