I think the fact that they are able to replicate the problem and there are recorded errors thrown is what makes you eligible for this. My guess is showing up, complaining of the problem and them not being able to replicate it and no error codes doesnt count as one of the 3 visits for the lemon law.

sounds like I could have written this description. I've been having this issue the last couple of days. Completely random and regardless of when the car was driven last, how long between starts or engine temp.

Good point. Mine never threw an error code but my dealer was willing to listen to me and actually check it out. One could argue though if they do anything besides saying we couldn't replicate that it would count towards qualifying for a lemon. I know at least in CA that the law not only covers a single repeat issue but also if you have the car in the shop for a certain number of days over in a year.

Correct. In California, a car is a lemon if it is out of service for a total of 30 days in the first 18 months or 18,000 miles (whichever comes first), or requires 4 repairs for the same issue, so long as the issue first arises in the first 18 months or 18,000 miles (whichever comes first). As a practical matter, this means that the manufacturer only has 3 chances to fix the issue. If the issue is a major safety problem, then the car can qualify as a lemon with fewer repairs.
