Oil Change (with filter?)

My daughter just had her oil changed for the first time at an independent German Auto place. Her Q7 has about 35k miles, and had always been serviced at the deanship before this (Audi of Thousands Oaks, CA). The guy told her the oil looked really bad, and questioned her if she had ever had is changed. She said yes, multiple times at the dealership. They preceded to change the oil, but then told her the problem is that the filter had never been changed, it was the original filter that came from the factory. He told her sometimes dealerships will not change the filter to save money, but it should always be changed, as it was building up sludge that was circulating in the oil.
So, is the filter from the factory different from the replacement filters the dealership would use? If not how would this guy know it was the original? Also, have any of you had the problem of the dealer not changing your filter? What should be her recourse against the dealer?

Dealership would use the filter model that the factory would have used. Every time I change the oil in either of my Q7's, it is always "black". Mileage between changes is anywhere from 2k to 6k. I always use proper VW spec oil and OE filters. Not cheap, mostly due to the oil.

I would not rely on the color of used oil for anything. My A6 get changed at 5,000 mile intervals and looks far worse than any other car in the family. The few times I have had a commercial analysis done the results were unremarkable. The keys are change the oil regularly, check the oil frequently. When an oil filter housing gasket goes, you will see a lot of oil loss - everywhere.

what a necrothread, but okay.. I'll bite.. yeh all realize we got Turbos right? you know how those Turbo's bearings are cooled and lubricated? your engine oil is pumped through that extremely hot chunk of metal.. now keep that in mind as you learn that black oil is not bad oil, its just an indication its seen high temps.
Ive changed the oil, gone on a spirited drive down some twisties and checked the dipstick after.. jet black with just a few hundred miles max, its normal.. dunno how anyone can claim to tell if oil is good or bad by how it looks.. if it don't look chunky, you need a laboratory to tell you anything about its current composition and capabilities.
