Cop to face re-trial for driving at 159 mph Wed Feb 1, 10:01 AM ET

LONDON (Reuters) - A traffic policeman cleared of speeding after being caught driving at 159 mph was told on Wednesday he will face a re-trial.

Justice Heather Hallett at the High Court said a junior judge in Telford, Shropshire had erred in acquitting police constable Mark Milton and ruled the case should be referred back to the lower court for a fresh hearing.

"Driving at those speeds on public roads without any warning in conditions, no matter how good, and no matter what the skills of the driver, amounted to dangerous driving," said Hallett, one of the country's top judges.

Milton, a qualified advanced driver, was recorded in December 2003, by an onboard camera in his upgraded unmarked Vauxhall Vectra police car travelling at 91 mph in a 30 mph zone and hitting 159 mph on the M54 motorway.

The legal top speed is 70 mph.

Milton's defence, accepted by the local judge Bruce Morgan in May 2005, was that he had taken the car on a test run to familiarise himself with it.

Morgan said the prosecution had failed to prove beyond reasonable doubt that he had driven dangerously and said the car was being "used for police purposes."

His decision prompted outrage in the media and condemnation from motoring groups and led to a challenge by the government's top lawyer, the Attorney General.

On Wednesday outside the High Court, Milton's lawyer told reporters the final outcome of the case could have wide ranging ramifications for the way police forces train their pursuit drivers.

Default There was just an article in WSJK about this guy and some of his co-workers.........

the discussion was about how ignorant and biased the traffic laws in the UK are between the havs and the hav-nots, the giv't and the regular blokes.
