Default OT: Anyone looking for a home?

Gents..well my buyers that were suppose to close today at 4:00 backed out 5 hours before closing due to "personal reasons"! I felt sick after hearing that news. So now I am the proud owner of 2 houses with 3 mortgages. What the hell is the personal reason? Better be a good one.

Did they leave a deposit or something to cover you for at least the next month?

Default Ya..this totally sucks..hopefully we get their earnest money as their reason to get out did NOT meet

3 Ways to get out of a house contract in CO are:
-1) Inpection Failure - Cant come to agreement on what needs to be addressed or house is a wreck and not worth fixing etc.
-2) Financing Issue - Cant get financing
-3) Appraisal Value grossly not in-line w/ price

So if they agree which I "think" they will agree to sign over the earnest money..we would get about 2 months of mortgage payments...what a PITA.

Default was it a liquidated damages contract or a specific performance contract?

Either way it sounds like you should get to keep their earnest money, unless the one of the deadlines was four hours before closing! E-mail me if there is anything I can help you with.

Default Oh man, that really sucks. I'm suppose to close w/ our buyers next week - I hope all goes well also

I beleive that you are going to get the earnest money due to the colorado law you stated.
