There was a police report taken. Maybe they estimated speed. But the question is, what are my damages? My insurance covers paint and body work and my doctor bills for the broken bone in my hand. How much can I get for pain and suffering for a broken hand? About $0.02, I bet. But I will think about it.

you would have to sue them to most likely launch and investigation into why they didnt go off. Besides getting you something for their mistake, you might uncover a problem in their system which would be potentiolly fatel to someone else. Just something to think about. From the impact having seen many accidents (im a fire fighter) I would say the impact was at least 10mph but I would need to do some calculations to figure out all the forces etc...

I MEANT to say that I'm very glad you were not injured seriously. That was a very scary looking impact.
I was t-boned in a similar way in downtown Palo Alto many years ago. A guy ran a red light trying to make it to some hot date. He came blasting out of a residential neighborhood on Emerson in an old pint-sized pickup truck. I was motoring through on Lytton (kind of coasting through) on a green. Luckily I heard his brakes and stepped on the gas. He nailed me in the left rear quarter panel, spun me around and put me up on the far corner sidewalk. I was driving a Toyota MR2. I was extremely glad that I didn't get hit like you did. I'm not sure I'd be here today. Again, I'm very glad you came out *relatively* unharmed.
