i have a late build date of 04. i need to gather hard evidence of other people that this has happened to and audi has replaced.

That might only make a difference if they made changes to the transmission between mine and yours. Doubtful but it shouldn't matter. I know that later on they did some dealer fixes on transmissions instead of replacing them. Mine failed fairly early and it wasn't the reverse problem so they wanted to get it back to Germany to investigate.

I've heard of others with the same problem so AoA is aware of it.

I have the same problem in my '04 S4. It only occurs when the outside temp is cold and the engine is cold. First 15 mins or so after start up, I have to shift into 2nd very deliberately. If I do it casually it sometimes pops out and ends up somewhere between 2nd and neutral - very annoying.

It's at the dealer's overnight and they'll see if they can reproduce the problem tomorrow morning.
