Default Anyone ever sue their DOT for pothole damage

and win?

Just blew up an OZ superleggera and a tire last night in a construction zone near my house. Apparently there were steel plates covering the crater earlier in the week that weren't there last night at 11pm.

Yeah, I'm F'in pissed.

Not likely to win man, sorry. OZ superleggera are light, but not very strong. If you live in pothole country, you should not run those IMO.

Default I live in NoVa, definitely not pothole country

been running these wheels for 5 years with no problems.

ive had friends get reimbursed from the city/town when they damaged their wheels form a pot hole. But the circumstances were different, one of which was due to the snow plow trucks damaging the road and creating a pothole.

My insurance wouldn't cover anything since they said that the pot hole was stationary and it was my responsibility to mis it.

They did say that I could pursue the issue with the township though.

Your best bet is probably small claims against the construction company especially if they new it was a problem and covered it with steel plate prior to you hitting. Either way, your first step is to seek compensation from the construction company and if they won't then you have to go to small claims.

Anyway just my experience and opinion.

If it was a pothole, i doubt it unless you can prove it was neglected for a while.

If it was a construction problem, that's way different. The construction co has a responsibility to ensure safety of vehicles. You should contact them and file a claim.
It will cost you nothing and maybe you get some satisfaction.

ABSOLUTELY, and TWICE!!!

Here are my stories:

First time, I was driving in a construction zone and came over an overpass. SLAM!!! Car went on two wheels and destroyed my front driver's ASA 18" rim. I called ODOT (Ohio) and left a message. He called me back, emailed me a PDF to fill out which was a description of what had happened and how much repairs were. Normally I do all my own work, so I went to a Goodyear service center and got a quote for a new Rim and Tire as well as an outer tie rod. Mailed it to ODOT with a 20 dollar filing fee (which I assume is only in place to prevent would be scammers). 2 months later and 2 phone calls following up on the issue I had a check for the damages as well as the filing fee.

Second time, getting off the highway in a construction zone and hit another hole. Ironically, it was the rim I just replace six months earlier. Called ODOT, this time they directed me to a insurance company. She asked me to email her quotes or receipts for the damages. I did the same Goodyear quote. This time they sent me MORE money than it would cost to repair it because they insisted on using all genuine OEM products. Ironically, a new OEM wheel is WAAAAAAAAAY more expensive than a ASA 18" wheel. I sent them a quote for 340 dollars, they sent me 620!!!! And it only took about 2 - 3 weeks.

In both instanced I never had to take pictures of the construction zones. I was informed that all construction zones must carry X amount of dollars as insurance for these issues.

Now, if you've broken something in a non-construction zone, you are SOL.

After 5 phone calls to different people, looks like VDOT has a process for this. Wish me luck
