I called the police and they told me that it is not neccessary to file a police report. The scene of the accident is total chaos, broken signs, and tire marks. Where does it say in the insurance policy that they will replace the vehicle if its low mile and under 3 months old?

Well, depends on your insurance company, but hitting a deer might not be considered a collision, so it will get covered on your comprehensive side of the plan, which is good, as it will keep your premiums down.
The downside is that, if indeed, your car is totaled, then you're only going to get back whatever book is on the car. So, if you got the car for $40,000, you might only get $36,000 back.
How well the car is after its repaired, depends on where it is repaired. No paint job paid for by an insurance company will ever be as good as what comes out of the factory. Otherwise, make sure they hvae a new digital/laser frame straightner (actually that's a misnomer, since most cars are unibody). They'll put all new parts back into the car and from the outside you'll never notice a thing. Just make sure you drive it before you sign off on the repairs. I mean, drive it. Make long left and right turns, short left and right turns, highway speeds and big and little bumps. If anything sounds out of the ordinary, then tell them to fix it right.
I mailed a deer in CT doing about 75-80 on the highway with a new mercury cougar. Car actually held up pretty damn well. F#cking airbag never deployed though - which is a good thing, actually, since I was able to maintain control of the car.
Anyhow... that sucks. best of luck!

Replaced lock carrier, the body parts, 1 intercooler, odd's and ends....$7200 or so.
If you have damage back to the doors, it will be much worse. My frame was still perfectly straight and the ft. end alignment did not require any adjustments after repair.

It's discressionary, but if the car is relatively new and hasn't been used in terms of low mileage, you have a better CHANCE - not guaranteed. Looks like if you want a new car you'd better be prepared for a good arguement.
Easiest way out for the insurance company is to pay you 2nd hand value for the car, meaning you suffer the depreciation.
Say you payed $40,000 for the car - now the car may be worth $32,000. You may have paid say $2,400 in payments on the car (3 months x $800) plus a downpayment of maybe 10% ($4,000).
This equates to you having personally paid $6,400 towards the car to date with it now only being worth $32,000, meaning that if the insurance company pays you book price of $32,000, you are still $8,000 short of a new vehicle and you actually owe the finance company the $32,000 that the insurance company will give you plus the "gap" of $1,600 to make the $33,600, plus any interest remaining.
To summarise, there are 3 options - you have a good chance of the insurance company replacing the car with a new one. They may decide to repair the car (which will never be the same again) and lumber you with it or, they'll give you a check for what they deem the car to be worth which more than likely means you'll be out of pocket..
Just trying to help... I've a background in Insurance and some uncomfortable experiences on the receiving end.
