Loose drivers side ground effect pannel

Hello,
Took our new S4 2001.5 on its maiden voyage this weekend to Vancouver Island. We really enjoyed the car!
Did find that the drivers side ground effect is loose. It sticks out about 1 inch in the center and can be pressed in, but pop right back out. I can see how you can hit this with your foot when you get out of the car and the previous owner could have bumped it with his foot every time he got out of the car.... Is this a common problem?

The dealer sent it to a body shop to have it fixed. Came back ok, then came loose again. Brought it back to dealer, who sent it back to body shop. Came back ok, and has since come loose a bit again!!! Each time the body shop had to order a new panel (which must be painted) and mounting bracket.
Apparently, the only thing holding the majority of the panel to the car is velcro, which appears to be a design flaw.
I gave up on it, but I'll be sure to check the new S4 to see if it will have the same problem.
