Default Need Help. Got hit by an uninsured driver.

Ok so yesterday while sitting at a stoplight i got my driver side taillight, 1/4 panel and bumber damaged by some fool that was too busy to pay attention to the road. Unfortunatly this guys doesn't have insurance(of course, just my luck)

Anyways, I was told by my bodyshop that the damage won't be more than $1000. not too bad, but i don't wanna have to pay my deductible($500). I was told by my bodyshop guy that i can have the deductible waived(or something to that affect) and have my insurance company go after the guy that hit me. Thus i don't have to pay the $500 dedectible and they'll take care of the damages.

Is what my bodyshop telling me true? just wanted some ammo before i call the insurance company today.

Default Did you file a police report?

If not, you may be screwed. Uninsured Motorists claims can be difficult without a police report. If they were easy, everyone would file claims this way.

Default Not only that, I would have made sure that the guy was arrested!

Driving without insurance is a crime in most states. Get him arrested, then threaten to prosecute unless he forks up the $$$ for the damage. What a jerk. I hope it works out for you.

I know your pain, as I was hit by a drunk driver in December and it has been a total mess with the insurance company. But, in the end, I didn't have to pay for anything, not even the deductible.

Default Seems that uninsured motorist insurance is Optional in Hawaii

I just did a web search. So, the question is, did you opt for Uninsured Motorist insurance? If not, you may have a hard time recovering your deductible.

I am sorry to hear this. It kind of makes the MA requirement for insurance a little easier...

Default Well, that's a catch 22 as well...

Yeah, we are insured if that happens, because we have to be by law, but there are two drawbacks: 1) we pay the mandatory premium for it; and 2) it actually encourages uninsured drivers, as evidenced by the fact that nearly 16% of the drivers in this state are not insured, resulting in even higher premiums.

We need serious jail time for driving without insurance if it was done deliberately, i.e. not because you forgot to pay a bill and it was cancelled without your knowledge.
