Volkswagen's Audi division recalls A6 Quattro sedans for faulty fuel gauges
June 26, 2000: 7:41 p.m. ET

DETROIT (Reuters) - Volkswagen AG's Audi division, the subject of a class-action lawsuit concerning faulty fuel gauges, said on Monday it is recalling 48,500 A6 Quattro sedans sold in the United States to fix a similar problem.

The German automaker said owners of the cars from model years 1998, 1999 and 2000 have been mailed letters, telling them they can schedule appointments for the repairs starting Aug. 7. In the meantime, VW will build supplies of the fuel gauges, said Audi spokeswoman Jennifer Garber, who would not comment on the pending litigation.

She said sulfur deposits can interact with fuel additives and cause the fuel sending units in the car's fuel tank to misread the level of gas.

Two Philadelphia-area law firms filed a class-action lawsuit against VW last month alleging faulty fuel gauges in the sedans, and seeking refunds for owners of the affected cars.

Audi's Garber said the recall, based on customer comments and complaints, was planned before the lawsuit was filed.

The lawsuit, filed on behalf of U.S. owners of certain 1998-, 1999- and 2000-model A6 Quattros, alleged the cars run out of gas despite having fuel gauges that read at least half full, said Kimmel & Silverman and Monheit Monheit Silverman and Fodera, the two law firms that filed the lawsuit in Montgomery County Court of Common Pleas outside Philadelphia.

The law firms are seeking refunds for Montgomery County, Pa., resident Andrew Fox and other class members on their purchase or lease of the cars, attorney Craig Kimmel told Reuters.

Kimmel said the class-action could be as large as 40,000 owners, and would rise as high as 100,000 if the problem goes beyond A6 Quattro models. He added that VW claimed it has been working on a repair for 21 months, but the law firms decided to proceed with the lawsuit.

"I'm fed up," Fox, a contractor from Villanova, said in a statement. "I hope Volkswagen realizes how potentially dangerous this problem can be. The gauge will go from full to empty and back to full within 10 minutes."

Fox said he has had his gauge replaced four times in less than a year. "This is completely unacceptable for a car worth over $40,000," he said.

Default What a sorry state the US is in when we file lawsuits over...

...faulty gas guages! Shouldn't you know that if you've driven 300 miles and the gas guage reads empty, there's a problem?

I can just see some guy entering the discount law firm now. "Um, I need some money, and the best I can come up with is this idea of suing Audi because my fuel sender broke. Can you help me?"

Problem? yes. Lawsuit issue? That one will be thrown out in court!

How pathetic!
Charles

Default I disagree with some of you. Sue their asses!!!!!...

Look, none of you have been through the **** that I went through with my NM TT. I was continuously told that there is no problem with the tranny, there is no bypass valve problem, the noise was normal, it's my driving style, perhaps I don't know how to drive a stick. Audi doesn't seem to know about any of these many problems that crop up over and over.

It's complete bull****! Audi has had problems with their fuel gauges on other models as well. They know they suck. They know the FWD trannies suck. They know the bypass valves suck.

They do not seem to be adressing these problems in the serious and expedious manner that is appropriate. I like the TT, and I like Audi, but they need to start taking some of this stuff seriously.

Interestingly, the one problem that was rapidly addressed, the suspension issue, was one that perhaps, really didn't need to be. So let's hope that Audi wakes up and starts taking some of these recurring bugs seriously. And if the lawsuits help, then more power to the lawyers.

I agree that we have an overly litigious society, but this is one time that I think the lawyers are right.
