Settlement settled?

Assuming this is the real Chuck Marshall, this post is from a thread on audittcca.com dated March 20, 2008.

The class action re: defective TT instrument clusters has been settled. Notice went out in the mail two days ago and should be arriving soon. Notice and claim forms are also available at www.instrumentclustersettlement.com. You may also wish to visit www.classcounsel.com for more information. The information that follows is a summary only. The full details are available at the above websites. If there is a conflict between the information in this post and in the Notice or Claim Forms on the website or mailed to you, the information in the Notice and Claim Form controls.

The settlement covers 2000 - 2004 and certain 2005 TTs and includes all current and former owners and lessees. There are three forms of relief: (1) a two-year extension (no limit on miles) of the original 4-year warranty (limited to the cluster); (2) if the warranty extension is already expired for you, you may be entitled to a free repair/replacement; (3) if you already paid for one or more repairs or replacement clusters, you can apply for full reimbursement of all out-of-pocket costs incurred for parts and labor. You may be entitled to one or all three of these forms of relief.

The key to relief in the settlement is the extension of the warranty on the cluster to 6 years (from the "In-Service" date --- see the Notice at www.instrumentclustersettlement.com for definition). The repair and reimbursement claims key off that period as well. For example, for the free repair/replacement, if the extended warranty period has already expired (i.e., your car's in-service date was 01/2001, meaning that the extended warranty expired on 01/2007), you can get the free repair or replacement if you can demonstrate that your cluster was failing at some time during the 6-year period. Full details are in the Notice, but essentially you can prove this by having a repair estimate or order, or by certifying that you took it to someone to look at and they told you it was broken. Read the Notice and Claim forms carefully when you make your claim and make sure you follow all the appropriate steps.

The qualifications for cash reimbursement are similar. The repair had to have taken place within 6 years of the in-service date. You have to be able to document the repair and cost. See the Notice and Claim Form for full details.

Please note that I will not be following this forum and will not be responding to posts.
