Lemon Law Question....

Has any of you living in CA have succeeded in buy back based on the Lemon Law due to 2nd gear problems. I have been trying to duplicate the problem with a dealer mechanic at no avail (three times up to now). Once out of the dealer lot the damn thing grinds. In addition I just got a faulty gas gauge last week.
Please, help me by telling me the steps I should take to start the process of the lemon law. Or even, how do I convince the dealer that hey need to do something to fix this problem

Get all your responses from him in writing. Only mail things to them using certified mail.
This will help with the lemon law process...
...will also help to communicate that you are serious (in case your dealer isn't taking you seriously).

I had 2nd gear problems on my TT, but the thing that did the car in was an irrepairable brake problem; thus a long, long buyback process - but a fair one. It's really difficult unless the car is incapacitated like mine, so you might want to get a lawyer like www.kabo.com

Either the car is a lemon via the definition of the lemon law, or it isn't. If it is, then Audi won't usually fight you too hard, as they know that they will lose if it goes to court or arbitration.
Be aware that they are allowed to depreciate the vehicle up to the point where the problem first occurred and was taken in for service. In my case, the grinding occurred after only a few thousand miles, so I didn't have to take a large depreciation hit. However, if I had "lived with" the problem for 20,000 before taking it in, they would have socked my with 20,000 miles worth of depreciation (ouch!)
Take it in as often as necessary. Make sure the car meets all lemon law standards. Get everything in writing. Retain all service invoices. Make sure these service records specifically mention the problem in question.
Be sure to have them write "Customer Requests Factory Assistance" on one or more service invoices. If they give you an invoice and it does not specifically state this in writing, insist on having a new invoice printed that clearly states this.
