I would borrow an OEM DV or buy one from someone. It can't hurt. It could just as easily be something else as it could be the Bailey. For AoA to stop work on the car, or the dealer to not even pull a stock DV off the shelf and continue work is a load of crap in my book. The damn part is not a new tranny costing thousands, it is a $40 part for god's sake! Either bring your own dv to the dealer or tell them to continue working and toss in their own DV, but tell them if the error code still shows, then you will don't think you should have to pay for the DV and you want your Bailey back in!

Might want to investigate some of these if you haven't done so by now.
Check the sensor that triggers the CEL for faults (would most likely need a diagnostics tool for this).
Check the secondary air compressor for any physical faults.
Check connectors to sensor and compressor for any faults. Unplug, check for any pins that might have been pushed out and then reconnect. Wiggle the wiring at the connector. You might discover a poorly crimped pin if the check engine light comes on.
Check the air plumbing in and out of compressor.
Also see pages 24-106 thru 24-122 of the Bentley manual for the troubleshooting guide.

I just installed a Forge valve about a month ago, and it cured the power surge problem my car was exhibiting. I was on OEM DV #2. Both OEM DVs worked great for about 1000 miles each, then they crapped out.

for the record, I was getting repeated 16795 (secondary air inj. fault) codes when my stock DV was going bad. it was definitely the DV, due to various familiar symptoms. after they replaced it with the latest valve ("N"), the fault codes and other symptoms have gone away. (at least for now :-) I have a Forge sitting on the shelf just in case, but for now, the "N" is behaving.
the 16795 can mean a bunch of things, only one of which is DV failure, but the DV is certainly one thing to consider. I agree with the other posters, have them stick in a Bosch DV and see what happens. if the problem remains, have them continue diagnosing the problem until they find it; then they or you can remove the stock DV and replace the original. if the DV fixes the problem, you pay; if not, they pay. if it's only $40, hardly worth arguing about anyway.
I don't know how often you're getting the 16795 codes - it might take a while to decide if things are "fixed" or not. in my case, the code came back several times over a 3-4 week period - once it took a week or so to return, but on other occasions it came back within a day or 2. so you might have to be a little patient during the period of diagnosis. good luck...

. . . and I've had my car in three or four times for CEL problems. But I guess if I do, I can always pop the OEM DV in . . .
